We are wanting to our my husbands cousin that was killed young with our sons name. His name was Damion but I prefer the spelling Damien. Do you think defeats the purpose to change the spelling?

No, it's still the same name. I think it's ok to change the spelling. Best of luck!

Spell it however you like it. It isnt taking away from honoring him at all ... and dont feel any need to explain the difference, unless you are asked.
